Funeral Expenses & Dependency Claims
If your loved one has been fatally injured in a motor vehicle accident, work accident or public liability incident, then you may be able to bring a claim for funeral expenses and loss of dependency.

Examples of losses that may be claimed by a relative or dependant of the person who sustained a fatal injury are:

Financial loss arising from the death of an income provider (this could be claims from the surviving spouse of defector partner, dependent children and other dependent persons).

For the loss of services provided by the deceased. ‘Services’ can include ordinary housekeeping, house maintenance and garden services.

Additionally, if your loved one was fatally injured whilst working in Queensland, or while travelling to or from work, you may be entitled to statutory benefits through WorkCover regardless of who was at fault for the accident

What about pain and suffering?

Damages are not recoverable for grief or sorrow and other distress resulting from the loss of a close family member. However, in some circumstances where a family member has sustained a in a psychiatric injury as a result of losing a close family member, they may be able to bring a claim for their own injuries.
